Justice Moynihan's Findings
On November 16, 1990, after a year of considering the facts of the case, Justice Moynihan delivered his written findings to the High Court of Australia. The judge's four hundred page report presented Mabo and his barristers with a bombshell which threatened to sink their case.
Mabo's credibility as the primary witness for the case was savaged by Moynihan, and Eddie's claim to land on Mer were totally denied in his report. Justice Moynihan concluded that Mabo had not been adopted into the Mabo family, for the purposes of inheriting family land.
The Queensland Government had succeeded in diminishing Eddie Mabo's credibility in the eyes of the trial judge.
