The Gove Decision Questioned
Following Justice Blackburn's decision, the question of whether the Common Law might recognise indigenous land rights was not entirely forgotten.
A number of legal commentators criticised the Gove Land Rights Case judgment and decisions by courts elsewhere, particularly in Canada, fortified the impression that Australia was out of step and wrong.
The High Court of Australia, in several decisions, hinted that the issue might be open to reconsideration.
