By the latter part of the eighteenth century, British Imperial policy held some regard for indigenous peoples and their rights.

Treaties were signed across much of North America and in New Zealand, while in 1763, a Royal Proclamation for North America acknowledged indigenous rights throughout much of the continent.

During the nineteenth century, court decisions in these countries provided further recognition of the rights of prior inhabitants. This protection was subsequently eroded, as more settlers arrived and pressure on land increased.

Since the 1960's however, the trend has been to restore a degree of recognition of indigenous rights. Unfortunately, in Australia, there was no prior recognition of these rights to re-establish.
