In proceedings that became known as "Mabo Number One", the single question considered by the High Court was whether the Queensland Act was valid.

The plaintiffs challenge was based primarily on the Commonwealth's Racial Discrimination Act.

They argued the Queensland Act was discriminatory because it took away the Meriam people's rights to the Murray Islands while leaving the property rights of other Queenslanders intact.
