The decision of the Privy Council in Amodu Tijani, concerning the former colony of Lagos, was relied upon by Justice Brennan in Mabo, where Viscount Haldane asserted that:
'A mere change in sovereignty is not to be presumed as meant to disturb the rights of private owners,' Amodu Tijani v Secretary, Southern Nigeria [1921] 2 AC at 407, per Viscount Haldane.
